On Sept. 11, 2001, Marine Lt. Col. Stuart Couch’s friend died co-piloting the second plane to hit the World Trade Center. Soon after, Couch became one of the first military prosecutors assigned to the U.S. military base at Guantánamo Bay to prosecute men alleged to have carried out the terrorist plot. Couch talked to Amy Goodman and Juan Gonzales of Democracy Now! about the experience.

Stuart Couch recalls his first trip to Guantánamo, and what he found.

"I was waiting to watch the interrogation of one of the detainees who had been assigned to me to prosecute his case. This was a detainee that was particularly cooperative and involved in some very serious activities in the Gulf region. As I was waiting in a room next to his interrogation room, I heard some loud heavy metal rock music playing down the—down the hallway. I went down to investigate. I thought it was a couple of guards that were off duty and didn’t realize that we were getting ready to conduct the interview. So I walked down the hallway, and as I reached the room where the source of the music was coming out, the door was cracked. And I looked into the room, and I could—all I could see was a strobe light flashing. The rest of the lights in the room were out, but from the flashes of the strobe light, I could see a detainee in orange sitting on the—seated on the floor and shackled, hand to feet, and rocking back and forth."

"There were two civilians who asked me, you know, what was I doing. And I said, "I’m Lieutenant Colonel Couch. You need to turn that down. What’s going on here?" And they just basically told me to move along, and shut the door in my face. There was a judge advocate reservist with me, and I said, "Did you see that?" And his immediate response: "Well, yes. That’s approved." And so, that was my first inclination that there was—of evidence of coerced interrogations going on at Guantánamo."

Couch ultimately would refuse to prosecute the detainee, Mohamedou Ould Slahi.

"It became clear that what had been done to Slahi amounted to torture," Couch says. "Specifically, he had been subjected to a mock execution. He had sensory deprivation. He had environmental manipulation; that is, cell is too cold, or the cell is too hot. ... He was presented with a ruse that the United States had taken custody of his mother and his brother and that they were being brought to Guantánamo." Couch says he concluded Slahi’s treatment amounted to illegal torture. "I came to the conclusion we had knowingly set him up for mental suffering in order for him to provide information," Couch said. "We might very well have a significant problem with the body of evidence that we were able to present as to his guilt."

Getting the agencies responsible for national security to communicate better was one of the main reasons the Department of Homeland Security was created after the Sept. 11, 2001, terrorist attacks.

But according to a recent report from the department's inspector general, one aspect of this mission remains far from accomplished.

DHS has spent $430 million over the past nine years to provide radios tuned to a common, secure channel to 123,000 employees across the country. Problem is, no one seems to know how to use them.

Only one of 479 DHS employees surveyed by the inspector general's office was actually able to use the common channel, according to the report. Most of those surveyed — 72 percent — didn't even know the common channel existed. Another 25 percent knew the channel existed but weren't able to find it; 3 percent were able to find an older common channel, but not the current one.

The investigators also found that more than half of the radios did not have the settings for the common channel programmed into them. Only 20 percent of radios tested had all the correct settings.

The radios are supposed to help employees of Customs and Border Patrol, the Transportation Security Administration, the Coast Guard, Immigration and Customs Enforcement, the Federal Emergency Management Agency, the Secret Service, and other agencies with DHS communicate during crises, as well as normal operations.

DHS officials did not immediately respond to questions from ProPublica about what effect the radio problems could have on how the agency handles an emergency.

The $430 million paid for radio infrastructure and maintenance as well as the actual radios.

In a response letter to the report, Jim H. Crumpacker, the Department of Homeland Security's liaison between the Government Accountability Office and the inspector general, wrote that DHS had made "significant strides" in improving emergency communications since 2003. But he acknowledged that DHS "has had some challenges in achieving Department-wide interoperable communications goals."

The recent inspector general's report is the latest in a string of critical assessments DHS has received on its efforts to improve communication between federal, state and local agencies. The Government Accountability Office reported in 2007 that the Department of Homeland Security had "generally not achieved" this  goal.

DHS has assigned a blizzard of offices and committees to oversee its radio effort since 2003, which the inspector general's report claimed had "hindered DHS' ability to provide effective oversight."

Also, none of the entities "had the authority to implement and enforce their recommendations," the report concluded. Tanya Callender, a spokeswoman for the inspector general, said the current office overseeing the effort hadn't been given the authority to force agencies to use the common channel or even to provide instructions for programming the radios.

The inspector general recommended DHS standardize its policies regarding radios, which DHS agreed to do. But it rejected a second recommendation that it overhaul the office overseeing the radios to give it more authority.

"DHS believes that it has already established a structure with the necessary authority to ensure" that its various agencies can communicate, Crumpacker wrote in his response letter.



The Blackwater Tapes

The April issue of Harper’s Magazine includes “The Warrior Class,” (paywall) a feature article by Charles Glass on the rise of private-security contractors since 9/11. The conclusion of the article describes a series of videos that were shown to Mr. Glass by a source who had worked for the private-security company Blackwater (now Academi, and also formerly Xe Services) in Iraq. Clips from the videos follow below, prefaced by Glass’s own descriptions:

The first [video], identified as “Baghdad, Iraq, May–­September 2005,” showed Blackwater convoys racing through town. Suddenly, the door of a Blackwater SUV opened and a rifle fired at passing traffic. “They opened the door,” my companion said. “You should never break the seal.”

The next tape had been taken by a camera in the turret of an armored vehicle. An [M4A1] fired from the turret at cars that had stopped to let the convoy pass. Whoever was firing the [gun] did so enthusiastically and often, sending rounds into parked cars and an overhead bridge. Another sequence showed a contractor vehicle rear-ending a car, shattering its back windshield.

The footage continued. A Humvee smashed into a car to move it out of the way. Guards swore at passersby. More armored vehicles smashed into civilian cars.

But what about the tape dated April 1, 2006, which was shot from the front seat of the fourth car in an armored convoy? Driving along a wide boulevard in Baghdad, the lead vehicle swerved close to the curb of a traffic island. A woman in a black full-length burka began to cross the street. The vehicle struck the woman and knocked her unconscious body into the gutter. The cars slowed for a moment, but did not stop, nor did they even determine whether the victim was dead or alive. A voice in the car taking the video said, “Oh, my God!” Yet no one was heard on the radio requesting help for her. Most sickeningly, the sequence had been set to an AC/DC song, whose pounding, metallic chorus declared: “You’ve been… thunderstruck!”
